Online Ordering Terms & Conditions
Occasionally, we may offer products for sale via our website. Information provided on the website does not constitute an offer outside of New Zealand.

Our online ordering service is an automated system to process orders placed with Christchurch Gold. While we strive to fulfill all orders, we cannot guarantee product availability at all times. Although we endeavour to maintain accurate and current product descriptions and pricing, we reserve the right to adjust the actual price if incorrect prices are displayed.

Prices and product details may be updated at any time without prior notice.

When purchasing products for business purposes, you acknowledge that the Consumer Guarantees Act 1993 does not apply. Ownership of all products supplied remains with Christchurch Gold until full payment is received. Risk of loss or damage to the products passes to you upon delivery.

Delivery of Products: We aim to dispatch customer orders within five business days from receiving the order. Delivery charges will be applicable at the rates current at the time of dispatch.

Duties and Taxes: Many international destinations impose duties and/or taxes on imported goods, whether the items are personal or commercial. Any duties or taxes incurred are payable by the recipient, and items may be held by the customs authority until payment is made. Customers are advised to check with the relevant customs authorities of their destination country for specific details. Information is also accessible via the New Zealand Customs website.

Return of Products: If you are not entirely satisfied with your purchase, you may return the product within 14 days of receipt, excluding custom-made items. You can choose either a replacement product or a refund of the purchase price (excluding shipping charges). Except for refunding or crediting the purchase price of any product we cannot supply or a returned product under the above conditions, Christchurch Gold will not, to the maximum extent permitted by law, be liable for any loss or damage (direct, indirect, or consequential, including lost profits) arising from the use of our online ordering service, or any delays or failures in providing the ordered products or service.

Website & Services

Our Website and Services utilise real-time third-party data feeds to display Product pricing. The Website also contains key details about Products and related Services, including stock availability (held by us and/or accessible via mint suppliers), indicative timeframes for collection and dispatch (including possible delays), the Market Window, and full specification information.

Real-time pricing: Prices shown are updated dynamically and may change based on live market activity. All prices on the Website are indicative only and are not confirmed until a Confirmed Order is created. A Confirmed Order is only established once full payment is received within the designated Purchase Window. Listed prices exclude shipping, processing, and any other applicable fees.

Inventory availability: The Website indicates the availability of each Product, including what is physically in stock, available via supplier order, or subject to delay. These availability indicators are not guaranteed and may fluctuate at any time due to sales activity or third-party changes. Fulfilment and dispatch depend on confirmed availability at the time payment is received.

Market Window: Online Orders can only be submitted during the specified Market Window, which varies between Products. Some Products are available 24/7; others have limited trading hours. Outside the Market Window, Products will be labelled ‘Market Closed’ and cannot be purchased online during that time.

Please ensure you carefully review all Website information for your selected Products before placing an Online Order. If you are unsure, contact us directly at support@chchgold.co.nz.

Accuracy: We aim to maintain accurate and reliable information across our Website and Services. However, unintentional errors or inconsistencies may occasionally occur. If any such issue arises, we may take corrective action—including cancelling affected Online Orders and issuing a full refund for any affected Confirmed Orders—while complying with your rights under applicable law, including the CGA or FTA. Information provided by our Website chatbot is for general assistance only and must be verified directly with our staff before being relied upon.

Submitting an Online Order does not guarantee immediate dispatch or collection of Products. Christchurch Gold sources Products from multiple suppliers on a non-exclusive basis. If we can only fulfil part of your Confirmed Order, we will notify you and offer either partial delivery or dispatch of the entire Order once all Product is available.
Orders are processed in the order they are confirmed, on a fair dealing basis, with Product allocated accordingly.

We reserve the right to temporarily suspend Website Services, including the Market Window and Online Orders, without notice if necessary—for example, due to data feed issues, software faults, malicious activity, or other operational disruptions.

Online Orders
You may only place Online Orders from a verified Christchurch Gold account and during an open Market Window.
Adding Products to your cart or initiating an Online Order does not reserve or secure stock. Stock is only allocated upon payment confirmation within the Purchase Window.
Each Online Order allows two payment methods:

Bank deposit: Pay to the Christchurch Gold bank account as shown on your invoice; or

Online gateway: Pay securely via our Website using our authorised third-party processor.

Once the Order is submitted, you will receive either an invoice or be redirected to the payment gateway. The price is locked for 30 minutes (the “Purchase Window”). If full payment is not received in our account within this timeframe, we may cancel or re-price your Order at our discretion.
To complete the Order, you must:
Pay the full amount listed within the Purchase Window; and

Where paying by bank deposit, email verified proof of payment to support@chchgold.co.nz.

Once payment is received in full, your Online Order becomes a Confirmed Order. Orders paid via the payment gateway become Confirmed automatically upon successful processing.
Until a Confirmed Order is created, all prices remain indicative and not guaranteed. Dispatch and collection are likewise not guaranteed until payment has been completed.

Security and AML conditions:
Christchurch Gold reserves the right to cancel or refund any Online Order if, in our sole discretion, the transaction does not meet our internal risk, identity verification, or Anti-Money Laundering (AML) compliance standards. This may include—but is not limited to—situations where we suspect attempted fraud, identity mismatch, unusual transaction behaviour, or activity inconsistent with the source of funds or purpose of purchase. If your payment is refunded for these reasons, we are under no obligation to provide further detail but will notify you promptly.

You acknowledge that all Online Orders and sales are deemed to occur in New Zealand. On confirmation and payment, legal possession of the Product is deemed to transfer to you within New Zealand, even if delivery is to occur later or to a different country.
You must have legal capacity and proper authority to place an Order. If acting for a business, you warrant that you are authorised to bind that business to the transaction. We may delay or cancel Confirmed Orders if:

There are technical issues beyond our control;

There are legal reasons, such as requests from law enforcement;

The Order is suspected to be connected to unlawful activity.

Sale of Product
If you wish to sell bullion or other Products to Christchurch Gold, you must first contact us using one of the following methods: By phone, using the contact number listed on our Website;

By submitting an enquiry via the Website’s contact form;

By email or live chat using the contact details provided on the Website.

Once your enquiry is received, we will contact you to discuss the details of the potential transaction. If both parties agree to proceed, we will provide a Purchase Confirmation Form that outlines the agreed terms, including the description of the Product, proposed pricing, payment method, and delivery or drop-off process.No binding contract is formed until:You have signed and returned the completed Purchase Confirmation Form to us in the manner specified; and

We have completed and approved identity verification checks in accordance with our legal obligations, including Anti-Money Laundering (AML) and Countering Financing of Terrorism (CFT) requirements.

We reserve the right to request identification documents and other supporting information as part of this verification process. The form and timing of identity verification will be determined by Christchurch Gold and must be completed to our full satisfaction before any purchase can be finalised. Christchurch Gold may, at its sole discretion, refuse to complete a purchase where: You fail to meet our identity verification standards;

The origin or nature of the goods raises concerns under AML/CFT obligations;

The transaction does not align with our internal risk management or compliance policies; or

We are unable to verify ownership or authenticity of the Product to our satisfaction.

In any such case, we may elect not to proceed with the transaction, and no payment will be made. If physical Product has already been provided to us, it will be returned to you (unless otherwise required by law or withheld pending investigation). Pricing offered in the Purchase Confirmation Form is subject to market conditions and may be time-limited. Unless otherwise agreed in writing, the price offered is valid only at the time the form is issued and may not be reoffered at a later time. Final settlement and payment will only occur once the Product has been received, verified, and accepted by Christchurch Gold, and all compliance checks have been satisfactorily completed. You confirm that you have the legal right to sell the Product and that the Product is not subject to any lien, charge, encumbrance, or third-party claim. If you are acting on behalf of another person or entity, you confirm you have full legal authority to do so. All sales to Christchurch Gold are deemed to take place in New Zealand and are governed by New Zealand law. We will not be liable for any loss, cost, or delay arising from non-compliance with the requirements above or any breach of applicable law by you.

Risk, Payment & Delivery

Acknowledgement of Risk
Christchurch Gold is a business specialising in the purchase and sale of precious metals, collectable coins, and related services. We are not a financial adviser or registered financial services provider. You acknowledge that we do not provide financial advice or issue regulated financial products. No disclosure documents (as defined under the Financial Markets Conduct Act 2013, the Financial Advisers Act 2008, or any similar legislation) have been or will be prepared in relation to our Services, Website, or Products.

Precious Metals
You acknowledge that gold, silver, and other precious metals are subject to volatile and rapidly changing global markets. Prices may rise or fall sharply with little or no warning. Accordingly, the buying, selling, or holding of such Products carries inherent risks. Before engaging in any transaction, you should carefully assess your financial circumstances and risk tolerance. Independent financial advice is strongly recommended if you are uncertain about the suitability of such transactions.

Agency Appointment
You appoint Christchurch Gold, and Christchurch Gold accepts the appointment, to act solely as your agent for the limited purpose of purchasing Products on your behalf via our Website or Services, subject to the terms set out herein.

Terms of Payment
You must pay all amounts due in full and without deduction or set-off. You are responsible for any applicable taxes, customs duties, or import tariffs arising from international shipments of Products. Invoices may be sent electronically to your nominated email address. If you provide proof of payment but fail to meet payment obligations within the timeframe stated on the invoice or within the designated Purchase Window, all amounts owing become immediately due and payable. Interest on overdue amounts accrues daily from the due date until full payment is received, at a rate of 2% above the current overdraft rate of our primary trading bank. This charge represents a fair pre-estimate of our loss and is not a penalty. We reserve the right to recover from you all costs incurred in recovering overdue amounts, including legal fees (on a solicitor-client basis) and third-party debt collection costs. Where a Purchase Confirmation Form is issued, all payments must be made in accordance with the terms specified therein. Refunds: We reserve the right to cancel and fully refund any online payment or purchase if, in our sole discretion, the transaction fails to meet our internal security protocols, fraud screening procedures, or Anti-Money Laundering (AML) policies. In such cases, we are not obligated to provide further justification. Refunds under these circumstances will be processed using the original payment method unless otherwise agreed. Payments will be made to you by direct credit to your nominated bank account or, where appropriate, by cheque (collected in person or sent via post).

Delivery
Products may be collected from our premises or delivered as agreed. Collection times will be communicated once your Confirmed Order is ready. Delivery dates listed on our Website are indicative only and subject to change. We accept no liability for delays in availability or delivery, and you agree not to hold us responsible for any losses caused by such delays. Deliveries may be made in instalments. Where Products are supplied “in trade,” we may cancel remaining deliveries without prejudice to recovering payment for Products already dispatched.

Ownership and Risk
Title and risk transfer as follows:

Click & Collect: Risk and ownership transfer to you once you collect the Product in person.

NZ Post Parcel Collection / Gold Safe Delivery: Title and risk transfer to you when you sign for and collect the Product from the designated location.

Secure Courier Service: Title and risk transfer to you upon signature confirming delivery to your nominated address.

If you redirect delivery from a designated NZ Post location to another address, you assume full risk upon redirection. If you instruct us to deliver with “Authority to Leave” or similar terms where no signature is obtained, you acknowledge that risk and title transfer to you once the Product is delivered to the nominated location. We recommend insurance coverage for such deliveries. If you choose not to use a Secure Courier Service (e.g. uninsured or non-signature delivery), risk and title transfer once the Product leaves our possession. For in-person collection, we may request photo ID. We reserve the right to withhold delivery if we are not satisfied with the identity of the person collecting the Product.


For Products Sold to Us
If you are selling Product to us:

You must send it via insured courier, with signature required.
Risk remains with you until our authorised personnel sign for the delivery.
Title transfers to us upon payment as outlined in your Purchase Confirmation Form.

If we decline to proceed with the purchase, we will return the Product to you either in person or via insured courier. Risk in returned Product transfers to you upon delivery to the nominated address or collection depot. Christchurch Gold accepts no liability for loss or damage after the point of delivery.


Consumer Guarantees
If you are acquiring Products from us for the purpose of a business, as defined by the Consumer Guarantees Act 1993 (CGA), you agree that the provisions of the CGA do not apply. If you are acquiring Products as a consumer (i.e. not “in trade”), then nothing in these Terms affects your rights under the CGA. In that case, you are entitled to guarantees under New Zealand law, including guarantees that goods are of acceptable quality and fit for purpose. However, due to the nature of the Products (e.g. bullion, precious metals, or collectable coins), the market value may vary significantly over time and is not protected by price guarantees, refunds for price drops, or a return policy due to buyer’s remorse.

Warranties
Except to the extent required by law, we make no warranties or representations (express or implied) in relation to:

The accuracy or completeness of any information on our Website;
The performance, fitness for purpose, or market value of any Product;
The availability of Products at a particular time or date;
Any result from using our Services or Products.
Christchurch Gold excludes all liability for any losses, costs, damages, or claims arising from your use of our Website or Services, except as required by law.


Intellectual Property
All intellectual property rights in the Christchurch Gold Website, including but not limited to content, design, graphics, logos, trademarks, product descriptions, layouts, and underlying code, are owned by or licensed to Christchurch Gold. Any breach of these Terms by you.
If, despite the above, we are found to be liable to you, our total liability (whether in contract, tort, negligence, or otherwise) is limited to the lesser of: The amount paid by you for the relevant Product or Service or NZD $1,000.

This limitation does not affect your rights under the Consumer Guarantees Act 1993 where applicable and not excluded by agreement.


Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to:

Natural disasters or extreme weather;
Pandemic or public health emergency;
Government restrictions, laws, or regulations;
Labour strikes or industrial disputes;
Power outages or telecommunications failure;
Transportation or courier delays;
Market disruptions or volatility;
Cyberattacks or technical failures.

In such circumstances, we may cancel or delay any order or delivery without liability to you. If we are unable to perform our obligations due to a force majeure event for more than 30 days, either party may cancel the affected order by written notice.


General Provisions
Governing Law
:
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

Severability: If any part of these Terms is found to be invalid or unenforceable, that part will be severed, and the remainder will continue in full force and effect.

Waiver: Our failure to enforce any right or provision under these Terms will not constitute a waiver of such right or provision unless expressly stated in writing.

Amendments: We may update or amend these Terms at any time. Changes will be effective upon publication on our Website. Continued use of the Website or Services after changes are made constitutes your acceptance of the updated Terms.

Entire Agreement: These Terms, along with any Purchase Confirmation or invoice, constitute the entire agreement between you and Christchurch Gold in relation to the purchase of Products and use of the Website, superseding any prior agreements, communications, or understandings.

Market Movement, Hedging, and Cancellation (Market Loss Policy)

Live market pricing
All quotes and prices are based on live global precious-metal markets and foreign exchange rates. Prices can change rapidly.

Price lock
Where a price is locked for a stated period (e.g., a cart timer or invoice validity window), the customer must complete payment within that period for the price to remain valid. If payment is not received in cleared funds within the lock period, the order may be cancelled or re-quoted at the prevailing price.

Hedging / market exposure
To manage market risk, Christchurch Gold may hedge (or otherwise offset) price exposure once an order is placed or a quote is accepted.

Customer cancellation after acceptance
If the customer cancels (or requests cancellation) after accepting a price/quote, Christchurch Gold may treat the position as needing to be offset. The customer is responsible for any market loss and reasonable costs incurred as a result of the cancellation, including: any adverse movement in the relevant metal price and/or FX rate between acceptance and offset; and any third-party fees (supplier, payment, or banking fees); and a cancellation/administration fee of NZD [$200].

Market gains
If the market moves favourably after acceptance and the customer cancels, Christchurch Gold is not required to pass on any market gain to the customer.

Netting and set-off
Christchurch Gold may deduct amounts owing under this clause from any refund otherwise payable.

Shipping, Insurance, and Collection

Dispatch windows
Orders are dispatched on business days only. Typical dispatch timeframe is [X–Y] business days after payment is received in cleared funds, unless otherwise stated.

Delivery method and signature
All shipments are sent using tracked delivery and may require signature on delivery (or depot collection), depending on the carrier’s policy and the shipment value.

High-value delivery restrictions
For security and insurance reasons, shipments above NZD [VALUE THRESHOLD] may be restricted to depot/branch collection or another secure delivery method. If the customer requests home delivery contrary to Christchurch Gold’s recommendation, Christchurch Gold may require the customer to accept reduced insurance coverage or no insurance (where carrier rules apply).

Depot/branch collection
Where a shipment is sent for depot/branch collection, the customer is responsible for collecting within the carrier’s holding period (often 3 business days). If a parcel is returned due to non-collection, the customer is responsible for redelivery fees and handling costs.

Risk and title
Risk transfers in accordance with the shipping method selected and carrier rules. Title may pass at dispatch or upon delivery/collection (choose one approach consistent with your Version 1 wording).

Insurance scope
Where insured delivery is offered, the insurance generally covers loss or damage in transit as determined by the carrier/insurer. Christchurch Gold’s responsibility is limited to the extent of any successful insurance claim or the replacement/refund remedy described in these Terms.

Supplier direct-ship
Certain products may be shipped directly from a supplier or vaulting/logistics partner.

Peak/holiday restrictions
Shipping may be paused or limited during peak periods (e.g., 15 December–15 January) or during carrier disruptions. Estimated delivery times are indicative only.

Support channel
Shipping enquiries must be made via email (not SMS) so they can be tracked and actioned efficiently.

Payments: Cleared Funds, Matching Name, and Third-Party Transfers

Cleared funds required
All orders require payment in cleared funds before dispatch or release of goods.

Account name match
Payments must be made from a bank account in the same legal name as the customer placing the order, unless Christchurch Gold approves otherwise in writing.

No third-party payments
Third-party payments (including payments from friends/family/businesses not named on the order) may be refused, refunded, or held pending verification.

Right to request information / hold / refund
Christchurch Gold may request additional information to verify payment source and identity for security or AML/CFT purposes. If satisfactory verification is not provided within a reasonable timeframe, Christchurch Gold may cancel the order and refund the payment (less any non-recoverable fees).

Cash policy
Cash acceptance (if any) is subject to Christchurch Gold’s published limits and AML/CFT obligations. $10,000 limited.

Selling to Christchurch Gold (In-Person and Mail-In)

Assessment and testing
When selling items to Christchurch Gold, items may be assessed using a combination of methods including weighing, visual inspection, magnet/acid testing, XRF testing, and/or electromagnetic/other non-destructive testing.

Quotes are indicative until confirmed
Any quote is indicative until Christchurch Gold receives and verifies the items’ metal content, authenticity, and condition.

Identification and legal requirements
Sellers must provide valid identification and any additional information required under applicable laws and Christchurch Gold policies (including secondhand dealing and AML/CFT requirements). Christchurch Gold may refuse to proceed if ID requirements are not satisfied.

Acceptable ID
Acceptable photo ID may include: NZ Driver Licence, Passport, or other government-issued photo ID. Proof of address may be required (e.g., bank statement or utility bill dated within [X] months). Christchurch Gold may decline non-government cards (e.g., “access” style cards) as primary ID.

Payout timing
Once items are verified and accepted, payouts are processed via the agreed method. Bank payments are typically made within [X] business days (unless additional checks are required).

Refusal and return
Christchurch Gold may refuse items that cannot be verified or that raise security/compliance concerns. Where mail-in items are refused, return shipping may be at the seller’s cost unless otherwise agreed.

Prohibited Use and Compliance (including AML/CFT)Prohibited conduct
You must not use the website or services for any unlawful purpose, including (without limitation) fraud, money laundering, terrorist financing, sanctions evasion, hacking, malware distribution, or any activity that Christchurch Gold reasonably believes may breach applicable law or compliance obligations.

Suspension / refusal
Christchurch Gold may suspend, refuse, cancel, or unwind a transaction where it reasonably believes doing so is required to comply with law, reduce risk, or meet security/compliance obligations.

Taxes and GST Treatment (NZ)GST
GST treatment depends on the product type and applicable law. Certain investment-grade precious metals may be GST-exempt in New Zealand when they meet legal criteria (including purity thresholds). Other metals and non-qualifying products may be subject to GST.

International taxes
For international shipments, the customer is responsible for all import duties, taxes, and customs charges in the destination country (unless Christchurch Gold states otherwise in writing).

Disputes and Complaints Process (with time limits)Contact first

Time limit
Disputes relating to an order, delivery, or a transaction must be raised within 7 days of delivery/collection (or within 7 days of the issue becoming reasonably apparent).

Resolution
Christchurch Gold will respond within a reasonable timeframe and will attempt to resolve disputes in good faith. If the dispute is not resolved within [30] days, either party may pursue available legal remedies.

Updates

Effective date

Existing orders
